View From the Ridge!

 

The end of 2007 is nearly upon us! In the past few months, we've had several changes in our organization. Ellen Miller, my business partner and close friend for over 14 years, recently was offered and accepted a fabulous international sales compensation position with Motorola. We shared many great times, grew both professionally and personally in our years together, and although I'll miss her wisdom and clarity, I wish her only extraordinary success. This year also saw us expand our services, our staff and our partners. Many of you already know Heather Hinson, our Executive Assistant, who strives to keep me on track and focused, and provides outstanding service to our clients. Elena Morera, a talented Human Resources professional also has joined us with a depth of HR experience, creativity and humor. We're also planning several new offerings to help you, our clients, thrive in 2008-stay tuned!


For most of us, there are always more activities than time these days, and so often the urgent overtakes the important. The theme of our articles is on a focus on what's important----"Secrets of an Expert Witness"--to minimize potential legal risk, and "Until Yesterday at 4:35 pm"--to avoid a business disaster, both resulting from poor planning or neglecting what's important. As always, we encourage questions, comments and topics you'd like to see in future issues.

Scales of Justice
In recent years, I've served as an Expert Witness in Human Resources cases. As a fan of crime solving mysteries, I found definite similarities to the crime- solving process in cases on CSI. The crime in this case was "wrongful termination" by an employer of a long time employee, and the subsequent lawsuit.
  1. At the Crime Scene-Obvious and the Hidden Clues.
    I began my work on the case by spending hours poring over the physical evidence readily available. I reviewed all relevant files and documentation, including the final termination checklist and documented exit interview, handbooks, company policy and procedure manuals, performance reviews, documented discussions, emails, notes and depositions of the employee, managers, and others. I was carefully analyzing exactly what was done, said or written, as well as what may not be present.

    #1 Secret---Look at the action as thoroughly as an outsider might analyze it
    • Would your files and documentation support the action taken?
    • Did you do what your procedures state you would do? Why or why not?
    • Do the clues (facts) make sense, stand up to scrutiny, or do they tell another story?
In Brief: Jane Stimson is the victim of this story. The characters are her husband, Charlie, and his friends, Hank Summers and Bill Rogers, business partners and equal owners of Central Brands, Inc. Central Brands was a thriving business until tragedy struck. Other characters in the story include a lawyer whose original advice is not taken; a lawyer who tells Jane the bad news; and Ted Holmes, who could have helped. Unfortunately, no one listens to him.
Except for the names used, this story is true. It happened yesterday. It will occur somewhere today. Tomorrow, who knows? The setting may be in your town. The principal characters may be you and your associates.
Central Brands, Inc. was a wonderful business, until yesterday at 4:35 P.M. Bill Rogers, Hank Summers and Charlie Stimson, who owned it equally, in 15 years had built it from scratch into a $6 million business. Industrious and financially cautious, they were best friends, well liked and even envied by their competitors. They handled their success well, never forgetting the difficult early days.

We are pleased to announce that Cherryll was recently appointed to the Board of Directors for Friends Outside of Santa Clara County.
Their Mission is to improve the quality of life of families and children impacted by incarceration, and assist with successful community reentry and family reunification for those transitioning from confinement to freedom.
